A mortgage borrower is empowered if he/she fully understands the loan process and knows what to anticipate. Armed with that knowledge, the borrower can command transparency, full disclosure, and accountability, and thereby secure suitable financing. Let’s take a look at the way a good Loan Representative (LR) can guide you through the loan process quickly, efficiently, with no surprises, and close the loan on time. We will look specifically at the the first 24 hours after application, and how much can be accomplished in that time. Let’s understand the sequence and the process before you have spent a penny or are in any way obligated.

What exactly is the loan process? Some people shop for mortgage financing and of these, many start the process by calling around asking for a rate quote and a Good Faith Estimate (GFE). It is important to realize, in case you don’t already, that verbal quotes mean nothing and GFE’s are non-binding and can be misleading for various reasons. I certainly do provide a GFE, as well as disclose the Annual Percentage Rate and whether there is a prepayment penalty, but these disclosures are only a piece of the puzzle.

Important: Until you are pre-approved and your rate is locked you have no guarantees. Once the rate is locked, you should get a written and signed lock confirmation disclosing the loan program, the amount of the loan, the interest rate, whether there is a prepayment penalty, and when the rate lock expires. To me, if the LR says he can’t provide the lock confirmation it is a red flag. You should also get an updated GFE showing all closing costs and fees. With this information you protect yourself and there can be no surprises.

You can accomplish the following in one day, at no cost to you, and with no obligation that you go forward:

1.Discuss your objectives and alternatives to decide on the loan programs best suited to your needs, as well as the documentation that you are willing and able to provide to accomplish your goals.

2.Complete a FULL application; necessary for pre-approval.

3.Seek formal pre-approval through Fannie Mae or Freddie Mac automated underwriter. The pre-approval is based on the same criteria that bank underwriters take into consideration. With the pre-approval, all you need to do is provide the documentation to verify your application, and then your file is ready to go to underwriting to seek final approval.

4.Get a pre-approval letter. At this point you should be able to lock a rate whenever you choose. Once again, after your rate is locked get the written and signed lock confirmation. If you are buying a property the letter can be very helpful and save you money. Realtors like a letter because they know they have a credible buyer who can close quickly if need be. Sellers will know you are not just window shopping, and you may be able to negotiate better terms.

5.Get an updated GFE and Truth-In-Lending (TIL)

6.Get a complete loan package, including disclosures, so they can be reviewed and you can ask any questions you may have. Disclosures need to be reviewed and dated at the time of application. This is an important thing for you to do because you can go over every mortgage-related document that you would need to sign before the file goes to the bank. This is the time to ask questions and raise any concerns.

Up to this point you have not spent a penny and are in no way obligated.

With your consent, the appraisal is ordered. You pay the appraiser and it will be shown as paid on the closing statement. Sometimes the cost of the appraisal will be credited back to you at closing.

Everything described above can be taken care of within 24 hours.

If you have not already done so, now is the time to provide your documentation required to confirm the information given at the time of application. When the appraisal is completed the entire loan package can be submitted to the underwriter.

For a purchase, you will need to provide the contract and contact information for your realtor, if you have one. There are other factors such as title, tax, and insurance that come into play, but that has nothing to do with the timing constraints of your lock confirmation.

That is basically all there is to it. The process requires organization and attention to detail, but it is not complicated if gone about correctly. Participation and cooperation on your part helps to expedite a successful closing. Working along with a good LR you can move things along efficiently, and at the same time, protect your interests.

Well I have mentioned it so I will expand it on it. New construction speculation, all of you probably know that is the hottest game in Real Estate right now. Here is why. You buy a property (get it under contract) it can take a year or longer to build (especially large condo projects) and they selling each unit (home) for more than the previous.

You have built in comps (comparable sales) when you close and if you are in a good market the property could be up 20% or more easily. This is one of my favorite strategies, and has worked great for the last five years. But the party is over, here in San Diego, because too many people are doing it.

Now, 10% of building is dumped on the Market right upon completion. This creates competition among sellers. This is why you must think outside the box. Following what is working for everyone leads to the greater fool theory.

At some point you need to take a look at areas that are not being touched and find out why. It may be obvious or there may be subtle signs of stagnation. You may find no answer at all, these are the areas that merit further investigation.

You also want to find out where the speculators are going next, try to stay one step behind in part of your campaign. In other areas of your investing don’t be afraid to get into un-chartered territories.
